Chapter I General Provisions

 

Article 1 To safeguard and propel balanced development of compulsory education and maintain educational fairness, in accordance with the Law on Compulsory Education of the People's Republic of China, the Measures on Implementing the Law on Compulsory Education of the People’s Republic of China in Jiangsu and other laws and rules, and combining with local realities, this Regulation was hereby formulated.

 

Article 2 This Regulation shall be applicable to implementation and management on balanced development of compulsory education in local administrative region.

 

Balanced development of compulsory education mentioned in this Regulation refers to implementing nine-year compulsory education in the city, which can realize basic equalization of entrance opportunity, school-running condition and teachers allocation, enable school management and education quality levels to overall upgrade, and guarantee all children and juveniles of school age to receive fair and quality compulsory education.

 

Article 3 Balanced development of compulsory education must stick to the principles of being in the charge by government, combining city and countryside, promoting fairness and improving quality.

 

Article 4 Balanced development of compulsory education shall carry out the system that the Wuxi Municipal People’s Government shall make overall plans and coordinate, and county-level city and district people's governments shall take management as the principal thing.

 

City, county-level city and district people’s governments shall include balanced development of compulsory education into national economy and social development planning, conduct balanced allocation of school-running resources, enhance guarantee level, establish and perfect responsibility and assessment mechanisms, and reduce differences in school-running conditions and levels between urban and rural areas, among all regions and among schools.

 

Town people's governments and sub-district offices shall, according to unified planning and requirements of county-level city and district people's governments, carry out related work on balanced development of compulsory education.

 

Article 5 The city education administrative department shall take charge of comprehensive coordination and education for balanced development of compulsory education in local administrative region.

 

County-level city and district education administrative departments shall take specific charge of organization and implementation for balanced development of compulsory education in local administrative region.

 

Development and reform, institution compilation, finance, public security, human resources and social security, urban and rural planning, construction, land and resources and other administrative departments shall take charge of relevant work for balanced development of compulsory education within the scope of their own responsibilities.

 

Article 6 Educational supervision institutions under city, county-level city and district people's governments shall conduct supervision, inspection, assessment and guidance on balanced development situation of compulsory education in own administration region, organize or entrust professional institutions to carry out public satisfaction survey on balanced development of compulsory education, and issue the result to the public.

 

Article 7 City, county-level city and district people’s governments and other related departments shall commend and reward social organizations and individuals that make outstanding contributions to balanced development of compulsory education.

 

Chapter II Entrance Opportunity

 

Article 8 City and county-level city people’s governments shall, according to school service radius and service population standard, and in accordance with the quantities and distribution of permanent population and children and juveniles of school age in own administrative region, formulate and adjust school setting planning, and reserve school construction land.

 

As for school setting planning, city and county-level city education administrative departments shall cooperate with urban and rural planning, land and resources, construction and other administrative departments to organize and compile, and then submit to the people's government at the same level for approval. As for service radius and service population standard of school, the city education administrative department shall cooperate with urban and rural planning and other administrative departments to formulate in accordance with relevant national and provincial rules and combing with local realities, and then submit to the Wuxi Municipal People’s Government for approval.

If city new development zones and residential quarters need to synchronously set up supporting school, reform and development, urban and rural planning, land and resources, construction and other administrative departments shall arrange according to relevant national and provincial rules.

Article 9 City, county-level city and district people’s governments and their education administrative departments shall guarantee students to attend school nearby.

County-level city and district education administrative departments shall, in accordance with school layout as well as quantities and distribution status of children and juveniles of school age in own administrative region, rationally confirm and adjust scope and enrollment scale of school teaching area, and issue to the public, and shall widely listen to opinions when confirming or adjusting scope of teaching area.

Schools shall organize enrollment within the scope of designated teaching area, and receive children and juveniles of school age in the teaching area. Results of the enrollment shall be issued to the public.

Article 10 Children and juveniles of school age shall attend school without sitting for entrance examination. Schools can’t hold or hold in disguised form selective examination related to school entrance, and can’t regard completion achievement, award or certificate as entrance requirement or placement basis.

Students enter school free of charge. No unit or individual can charge expense linked with entrance under any name.

Article 11 City, county-level city and district people’s governments shall, in accordance with quantities and distribution of disabled children and juveniles of school age and according to relevant national and provincial rules, set up special education schools (classes), and guarantee those children and juveniles to receive and finish compulsory education.

Disabled children and juveniles of school age that have the ability to receive general education can attend special education school (class), or learn in regular class at general school; and schools can't reject.

Article 12 County-level city and district people's governments shall guarantee the right of fairly receiving compulsory education accompanying children of people coming to Wuxi.

If accompanying children of people coming to Wuxi that conform to relevant situations want to accept compulsory education in residence places, their parents or other guardians shall apply to attend to local county-level city and district education administrative departments as stipulated, and the departments shall make overall arrangements, primarily public schools.

Article 13 City, county-level city and district people’s governments shall formulate and complete living expense subsidy policies for students with financial difficulties, establish subsidy systems of government leadership and social participation, and guarantee that children and juveniles of school age won’t be deprived of education or stopped schooling because if economic hardship.

Chapter III School-running Conditions

Article 14 City, county-level city and district people's governments and their education administrative departments shall put national and provincial general middle and primary school construction standards into practice, stick to urban and rural unification, propel compulsory education school standardization construction, and improve school standardization construction level following economic and social development.

Article 15 County-level city and district education administrative departments shall, according to school-running scale standard and that of the number of students at class, reasonably control school-running scale. Regions with relevant conditions can gradually reduce students at class, and overall propel small-sized class education.

School-running scale standard and that of the number of students at class shall be formulated by the city education administrative department in accordance with relevant national and provincial rules and combing with local realities.

Article 16 County-level city and district people's governments and their education administrative departments shall, according to site selection requirements and technical standards stipulated by the state and the province, build schools, and make sure that school buildings and sites can adapt to school-running scale and education teaching requirements, and that infrastructure is complete.

School buildings shall reach key fortification seismic fortification criterions, and conform to disaster prevention and risk avoidance safety requirements.

Article 17 County-level city and district education administrative departments shall conduct balanced configuration on schools' education and teaching facilities and equipment, give priority to relatively weak schools, and make sure that all schools reach relevant national and provincial school-running standards and that school-running conditions among primary schools and middle schools maintain balanced, and the difference situations can conform to national and provincial rules and requirements.

Schools' education and teaching facilities and equipment shall conform to relevant national and provincial quality standards and material selection requirements.

Article 18 School building construction and facility configuration shall stick to the principle of running school diligently and thriftily, and reflect the resource saving and environmental friendly demands.

Article 19 City, county-level city and district people's governments and their education administrative departments shall reinforce construction of special education schools (classes), improve school-running conditions, and guarantee the sites and facilities can satisfy the demands in study, living and rehabilitation of disabled children and juveniles.

General schools shall, according to relevant rules, establish special education resources classrooms, providing conditions and assistances in study, living and rehabilitation of disabled children and juveniles of school age that learn there.

Article 20 City, county-level city and district people's governments and related administrative departments shall reinforce education informatization construction, perfect construction and management systems of information network infrastructures and digital resources, and accelerate regional sharing of quality education resources.

Chapter IV Teachers Configuration

Article 21 County-level city and district people's governments shall, according to the standards on configuration of middle and primary school teaching and administrative staff members and in accordance with the number of students in local administrative region, check and ratify configuration of school teaching and administrative staff members during compulsory education, and implement dynamic management.

County-level city and district institution establishment, education and human resources and social security departments shall, according to approved configuration of school teaching and administrative staff members, arrange adequate full-time subject teachers, and guarantee actual requirements for education and teaching.

Article 22 County-level and district institution establishment, education and human resources and social security departments shall conduct balanced configuration on teachers, and make sure that the proportions of teachers and students, of backbone teachers and of teacher post structures among local schools of the same kind, and that the difference situations conform to national and provincial rules and requirements.

Teacher post setting, teacher cultivation and training and configuration of backbone teachers shall give priority to relatively weak schools, and encourage and support teachers to teach at the schools.

Article 23 County-level city and district people's governments and their education administrative departments shall perfect teacher management systems, establish and improve regular exchange systems of principals and teachers, organize principals and teachers to conduct rational flow between urban and rural areas and among schools, and facilitate balanced configuration of regional teachers. Specific measures shall be formulated by county-level city and district education administrative departments and relevant departments.

Article 24 City, county-level city and district education administrative departments shall establish and improve teacher training institutions, perfect training systems of city, county-level city and district schools, carry out training on all staff members and backbone teachers, accelerate teachers’ professional development, and elevate teaching body quality.

Chapter V School Management

Article 25 County-level city and district people's governments and their education administrative departments shall, according to relevant national, provincial and municipal laws, rules and management standards, strengthen school management, establish and complete objective management, performance assessment and evaluation motivation mechanism, and guarantee all schools can provide quality and balanced education services.

County-level city and district people's governments and their education administrative departments can’t separately set up key schools and non-key schools or set up in disguised form; and schools shall carry out balanced configuration on interior education resources, and can’t separately set up key classes and non-key classes or set up in disguised form.

Article 26 County-level city and district people’s governments and their education administrative departments shall legally employ principals according to officeholding conditions and qualifications stipulated by the state.

City, county-level city and district people’s governments and their education administrative departments shall reinforce construction of principal teams, conduct professional training on principals, carry out assessment on those work, and enhance their abilities in running school and management.

Article 27 City, county-level city and district people's governments and their education administrative departments shall propel construction of modern school system, put principal accountability system at primary and middle schools into practice, and facilitate schools to implement legal and autonomous management.

Schools shall reinforce teacher management, safety management and other system construction, give play to roles of teaching and administrative staff members' (representatives) meeting, board of governors and parent committee, and accept social supervision.

Chapter VI Education Quality

Article 28 City, county-level city and district people's governments and their education administrative departments shall implement relevant national and provincial quality standards of compulsory education, perfect education quality appraise and assessment mechanisms, intensify supervision on education quality work, and guarantee all schools can reach education quality requirements stipulated by the state and the province.

No organization or individual can issue further education indexes to education administrative departments, schools or teachers, can rank regions and schools by enrollment rate, and can regard students’ subject test score and further education situation as main standards for evaluating or assessing departments, schools, teachers and students.

Article 29 Education and teaching work shall comprehensively implement national policies for education, stick to facing all students, adhere to organic unification in moral education, intellectual education, physical education, aesthetic education and other aspects, pay attention to cultivating students’ sense of social responsibility, innovative spirit and practical ability, and promote integrated development of students.

Schools shall standardize school-running behaviors, propel quality-oriented education, carry out curriculum setting rules and education and teaching plans, standardize education and teaching management, and relieve students’ overweight course load.

City, county-level city and district education administrative departments shall reinforce construction of education and scientific research institutions and teams, encourage and support schools to conduct education and teaching reform, develop and open school-based curriculums that can satisfy students’ personality development, form school-running characteristics, and enhance education quality level.

Article 30 County-level city and district people's governments and their education administrative departments shall drive sharing of quality education resources, guide quality schools to give play to radiation and leading roles, encourage to establish school alliances, explore collectivization school-running, carry out counterpart assistance, conduct management in school districts, and facilitate balanced development and integral elevation of school-running level.

Article 31 City, county-level city and district education administrative departments shall carry out monitoring on quality of compulsory education in local administrative region, and issue the results to the public.

Chapter VII Fund Guarantee

Article 32 County-level city and district people's governments shall comprehensively include funds for compulsory education into financial budgets and separately list, guarantee that the increase proportion of financial appropriation for compulsory education is higher than that of financial recurring income, and ensure gradual increases of funds for compulsory education on average according to the number of students at school and of per capita public expenditure of students as well as teachers' wages, welfares and social insurance treatment.

City, county-level city and district people's governments shall legally levy sufficient extra charges of education funds and local education, and accrue sufficient education funds from net income of land leasing as stipulated.

Extra charges of education funds and local education as well as the education funds accrued from net income of land leasing shall be comprehensively arranged and used by city, county-level city and district financial departments and education administrative departments as stipulated.

Article 33 County-level city and district people's governments shall, according to relevant rules, conduct sufficient arrangement on and appropriate students’ per capita public expenditure in a timely manner; and shall moderately improve standards towards schools with relatively smaller school-running scale, for ensuring their normal school-running demands.

The city financial and education administrative departments shall formulate basic standard for students’ per capita public expenditure which is unified in urban and rural areas but not below provincial standard, and gradually rise in accordance with financial situation, school-running demand, price level and other factors. County-level city and district financial and education administrative departments shall formulate such standards not below the city one.

Per capita public expenditure of students at special education schools (classes) shall be arranged according to the standard of being not less than tenfold that expenditure of students at general schools.

Article 34 County-level city and district people's governments shall, according to relevant standards, arrange sufficient expenditures for maintenance and reconstruction of school buildings, and guarantee demands for daily maintenance of school buildings.

The city financial and education administrative departments shall formulate unified basic standards on expenditures for maintenance and reconstruction in urban and rural areas, and gradually enhance according to the actual demands. County-level city and district financial and education administrative departments shall formulate such basic standards not less than that stipulated by the city.

Article 35 City, county-level city and district audit departments shall carry out audit supervision on input, utilization and management on expenditures for compulsory education.

The education supervision institution under the Wuxi Municipal People’s Government shall cooperate with the city education, financial and statistics departments to carry out regular supervision on input and implementation of expenditures for compulsory education by county-level city and district people's governments, and issue the results to the public.

Chapter VIII Legal Responsibilities

Article 36 If county-level city and district people’s governments and their related departments violate rules of this Regulation and have one of the following situations, superior people’s governments and their related departments shall order them to correct within a definite time, and circulate a notice of criticism; and if in serious cases, people in direct charge and other directly responsible people shall give administrative sanction according to law:

(1) Fail to make overall arrangements on eligible accompany children of people coming to Wuxi to accept compulsory education in places of residence;

(2) Fail to check compilation for teaching and administrative staff members during compulsory education or arranging sufficient full-time subject teachers as stipulated;

(3) Set up key schools and non-key schools or set up in disguised form;

(4) Fail to equip education and teaching facilities conforming to relevant national and provincial quality standards and selection demands; or

(5) Difference of school-running conditions and teachers configuration among schools of the same kind within regions don’t conform to national and provincial standards and requirements.

Article 37 If schools violate rules of this Regulation and set up key classes and non-key classes or set up in disguised form, the corresponding education administrative departments shall order them to correct within a definite time; if the cases are serious, the persons in direct charge and other directly responsible people will be given sanctions according to law; and if the cases are severely serious, the principals, persons in direct charge and other directly responsible people will be dismissed or terminated employment relationship.

Article 38 Units violating rules of this Regulation and having one of the following circumstances will be penalized according to relevant laws and rules:

(1) County-level city and district people's governments or education administrative departments issue enrolment index, and rank regions and schools depending on enrolment rate, or take students’ subject test scores and enrolment situation as main standards for assessing and evaluating working performances of departments, schools and teachers;

(2) Schools charge expenses linked with entrance;

(3) Schools refuse to receive disabled children and juveniles of school age and having the ability to accept general education to learn in regular classes; or

(4) Schools refuse curriculum setting rules or education and teaching plans.

Chapter IX Supplementary Provisions

Article 39 Schools mentioned in this Regulation refer to schools established by the state and implementing compulsory education.

People coming to Wuxi mentioned in this Regulation refer to people living in Wuxi for working, living and attending school, except those people live in Wuxi because of business, medical treatment, tourism, relative and friend visit and others and expected to leave the city.

Article 40 If social organization or individual wants to establish non-state-run school according to law and carry out compulsory education, they shall implement in accordance with relevant laws and rules; and if some behaviors haven’t been stipulated by relevant laws and rules, they shall implement in accordance with this Regulation.

As to private schools undertaking compulsory education tasks, city, county-level and district people’s governments shall give corresponding policy support and fund support as stipulated.

Article 41 This Regulation shall be put into effect from May 1, 2014.
