The Measures for the Administration of Civilian Unmanned Aerial Vehicles in Wuxi have been examined and approved at the 10th Executive Meeting of the Wuxi Municipal People's Government held on July 25, 2017, and are hereby promulgated and shall come into force on September 1, 2017.

Measures for the Administration of Civilian Unmanned Aerial Vehicles in Wuxi

 

Article One In order to strengthen the management of civilian unmanned aircrafts and maintain public safety, according to the Civilian Aviation Law of People's Republic of China, the Regulations of General Aviation Flight Control of the State Council and the Central Military Commission and the reality of Wuxi, the Measures are formulated as follows.

 

Article Two The Measures shall apply to the registration, flight and safety control of civilian unmanned aircraft within the administrative area.

 

The term, civilian unmanned aircraft (hereinafter referred to as the civilian UAV), refers to aircraft engaged in non-military, non-police and non-customs missions with self-contained airborne flight control system and with no pilot.

 

Article Three City, city (county) people's governments shall strengthen the leadership over the management of civilian UAV, establish a joint meeting system of civilian UAV, research on major issues of civilian UAV management, and coordinate to solve the major problems in the management.

 

Article Four Public security organs are responsible for the safety management of civilian UAV in their administrative areas.

 

Departments of transportation, radio management, agricultural machinery, sports and others shall act in accordance with their respective functions and responsibilities and do a good job in the management of civilian UAV.

 

Article Five Encourage and support the civilian UAV industrial associations, clubs and other social organizations to establish civilian UAV industrial management system, strengthen self-discipline, conduct propaganda, training, consulting and other related services, guide the civilian UAV sales units, civilian UAV holders, civilian UAV pilots to carry out business and flight according to the law.

 

Article Six The Wuxi Municipal Public Security Bureau shall establish civilian UAV management service system to provide free software download, flight report, information dissemination, technology consulting, real name registration and other services, and conduct corresponding management work.

 

Article Seven Civilian UAV sales unit shall record the purchaser's name, ID number, contact name, and the civilian UAV’s model, serial number and other relevant information, and inform the relevant provisions and operation instructions to buyers.

 

The holder of a civilian UAV and the pilot of a civilian UAV shall register with the civilian UAV management service system for information registration.

 

The sales units of civilian UAV, the holders of civilian UAV and the pilots of civilian UAV shall be responsible for the authenticity of the information recorded or registered.

 

Article Eight If civilian UAV is transferred, damaged, abandoned, lost or stolen, the holder of the original civilian UAV shall promptly log on the civilian UAV management service system and cancel registration information.

 

If a civilian UAV is transferred, the holder shall concurrently change the registration in the civilian UAV management service system.

 

Article Nine Civilian UAV pilot should be familiar with the civilian UAV operated by them; those who are unable to master it should participate in corresponding technical training.

 

Minors driving civilian UAV shall be guided by the adults who have mastered the handling skills of civilian UAV.

 

Article Ten Before fly civilian UAV, pilot should report the take-off position through the civilian UAV management service system and conduct a comprehensive inspection on battery reserve, oil components and other components, to ensure the civilian UAV to meet the requirements.

 

Civilian UAV pilot shall not drive civilian UAV after drinking.

 

Article Eleven In addition to the fly airspace, the fly radius of civilian UAV shall not be greater than 500 meters and the relative height shall not be higher than 120 meters; civilian UAV that flies within a radius of 500 meters with the highest barrier higher than 120 meters, the flight height shall not be more than 20 meters above the highest obstacle.

 

The flight of a civilian UAV shall be subject to air traffic control and shall not endanger the personal and property safety of the personnel on the ground.

 

Article Twelve If civilian UAV pilot fails to report the take-off position in accordance with the regulations or if the civilian UAV fails to fly in accordance with the provisions, the public security organs may use UAV counter equipment.

 

Except for the public security organs and units approved according to law, other units and individuals may not use UAV counter equipment.

 

Article Thirteen Prohibit the civilian UAV flying in the following areas:

 

1 Clearance zone of military and civilian airfields;

 

2 Major prevention and control areas of military, communications, water supply, power supply, energy supply, hazardous goods storage, large reserves, state organs, stations, terminals, and ports that concern the people's livelihood, national security and public safety, and the surrounding 100-meter range;

 

3 Railway and highway and the two sides within 50 meters;

 

4 Areas banned by the Wuxi Municipal People's government;

 

5 Other areas prohibited by laws and regulations.

 

Article Fourteen Prohibit using civilian UAVs to carry out following acts:

 

1 Videotaping military installations, important Party and government organs and other secret places;

 

2 Disrupting the work, production, teaching, scientific research and medical order of organs, groups, enterprises and institutions;

 

3 Obstructing the personnel of state organs to perform their duties according to law;

 

4 Chasing, blocking others, or making noise, interfering with the normal life of others;

 

5 Carrying explosive, toxic, radioactive, corrosive substances or infectious pathogens;

 

6 Throwing or dumping articles or harming others or damaging public or private property;

 

7 Peeping and videotaping personal privacy;

 

8 Other acts prohibited by laws and regulations.

 

Article Fifteen Large-scale and important activity site shall not be allowed to fly civilian UAV.

 

If need UAV in a large and important activity, the organizer or the relevant unit shall submit the relevant materials to the public security organs before the event, and conduct security work in accordance with the requirements of the flight of civilian UAV.

 

The public security organs shall disclose the prohibited flight time and area of civilian UAV of large and important activities.

 

Article Sixteen Public security organs shall, in conjunction with departments of transportation, radio administration and sports, formulate emergency response plans for civilian UAV, which shall be submitted to the people's governments at the same level for approval before they are implemented.

 

Emergency response programs of civilian UAV should be regularly exercised.

 

Article Seventeen The public security organs shall establish an integrity management system of civilian UAV holder and pilot, standardize the integrity behavior of related units and personnel of civilian UAV, and include into the public credit information management system in accordance with the provisions.

 

Article Eighteen Actions in violation of the provisions of the first paragraph of Article Ten stipulating that civilian UAV pilot fails to report take-off position of civilian UAV through civilian UAV management service system in advance shall be given a warning by the public security organ. The pilot shall be ordered to make corrections; and those who refuse to correct shall be fined not less than 3,000 yuan, but not more than 10,000 yuan.

 

Article Nineteen Actions in violation of the provisions of the first paragraph of Article Eleventh shall be given warning and ordered to correct by the public security organ; those who refuse to correct shall be fined not less than 5,000 yuan, but not more than 30,000 yuan.

 

Article Twenty If in violation of the provisions of the second to fourth items of Article Thirteen and the first paragraph of Article Fifteenth, the public security organ shall take emergency measures; if the circumstances are serious, they shall be fined not less than 10,000 yuan, but not more than 30,000 yuan.

 

Article Twenty-One Actions in violation of the provisions of the first item of Article Thirteenth, and the first to seventh items of Article Fourteen shall be dealt in accordance with the Public Security Management Punishment Law of the People's Republic of China, the Methods of Clearance and Environmental Protection of Sunan Shuofang International Airport and other relevant provisions.

 

Article Twenty-Two Departments and units fail to fulfill the civilian UAV safety management responsibilities in accordance with the provisions of the Measures shall be given administrative sanctions by the higher administrative departments and supervisory organs; if a crime is constituted, criminal liability shall be investigated in accordance with the law.

 

Article Twenty-Three Actions in violation of the provisions of the Measures shall follow other related laws and regulations.

 

Article Twenty-Four The management of low-altitude, slow and small aircraft and air floating objects shall be carried out in accordance with the Measures.

 

Article Twenty-Five The Measures shall come into force on September 1, 2017.
